New Hampshire Contest and Sweepstakes Laws
New Hampshire's gambling offences sit in RSA 647:2. It defines gambling as risking something of value on a future event you don't control, in return for the chance to receive something of value. The section has no blanket exemption for promotions or giveaways, so the structure of your giveaway carries the weight.
Two details matter for promoters. The statute's "something of value" definition includes a sweepstakes ticket handed over with a purchase when the goods alone don't justify the price. Its sweepstakes definition is tied to promotions played on a gambling machine in an establishment the operator controls, which an online giveaway isn't. Charitable raffles are handled in RSA 287-E, with licensing, so they aren't a model for a brand's giveaway.
To stay clear in New Hampshire:
- Don't sell chances or bundle entries with a purchase.
- Pair any paid Action with a free alternative method of entry (AMOE).
- Publish your rules, prize and winner selection in your Terms & Conditions.
Our Contest & Sweepstakes Laws by State in the U.S. guide covers the other states.
This isn't legal advice. Ask a New Hampshire attorney if entry involves any payment.

How Do I Implement an Age Verification Popup?
Use the Age Verification Popup template, a full-screen Capture with Yes and No buttons that redirects anyone who taps No. It's self-declared, not ID checked.
