Washington Contest and Sweepstakes Laws

In Washington, contests and sweepstakes are permitted when structured to avoid falling under the legal definition of a lottery. A lottery in Washington is defined by the elements of prize, chance, and consideration. Sweepstakes must eliminate consideration by offering a Free Alternative Method of Entry (AMOE), while contests eliminate chance by requiring skill-based entry.

Promotions in Washington must clearly disclose eligibility requirements, methods of entry, odds of winning, prize descriptions, and complete terms and conditions. No purchase or payment may be required to participate or win. Promotions must also comply with the Washington Consumer Protection Act, which prohibits unfair or deceptive marketing practices.

Charitable gaming activities, such as raffles and bingo, are separately regulated by the Washington State Gambling Commission. Private business promotions targeting Washington residents must prioritize transparency, provide free entry options, and ensure compliance with state gambling and consumer protection laws.
